Reporting infringement
To be effective under the DMCA, your notice must be in writing and include all of the following:
- A physical or electronic signature of the copyright owner, or someone authorized to act on their behalf.
- Identification of the copyrighted work you say has been infringed. If several works are covered by one notice, a representative list of them.
- Identification of the material you say is infringing, with enough detail for us to find it — a URL to the specific video or page is best.
- Your name, address, telephone number and email address.
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on their behalf.
An incomplete notice may not be effective. If yours is missing something we will tell you what.
Before you send a notice
Much of the film on Starlight was recorded by a videographer hired by a club, school or event company, and the rights depend on that engagement. If your dispute is really about who owns film your organization commissioned, contacting the organization directly is usually faster than a DMCA notice.
What happens next
- We review the notice and, if it is effective, remove or disable access to the material promptly.
- We tell the user who uploaded it that we have done so, and give them a copy of your notice — including your name and contact details, which the DMCA requires us to pass on.
- We tell them how to file a counter-notification.
Counter-notification
If your material was removed and you believe that was a mistake or a misidentification, you can send a counter-notification. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the district where you live — or, if you are outside the United States, the District of Connecticut — and that you will accept service of process from the person who sent the original notice.
On receiving an effective counter-notification we forward it to the person who filed the original notice. Unless they tell us they have filed a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days.
Repeat infringers
We terminate the accounts of users who repeatedly infringe copyright, in appropriate circumstances. We count effective notices that are not successfully countered, and we take account of context — an organization that removes disputed film promptly is treated differently from one that re-uploads it.
Misrepresentation
Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and legal fees. Please be sure before you file.
